Know the issues you need to address during a divorce

When you are going through a divorce, you have to make sure that all aspects of the divorce are handled before it is finalized. There are several things that this includes. You might want to make a checklist so that you can discuss each point with your attorney so that you can check each item off as you address it.

Let’s start with the basics of the divorce. First, if you have property, you will need to decide what is going to happen to the property. Typically, this includes real property and vehicles, but it can include any other types of property that is part of the marriage. You should also address retirement accounts and investments if they are part of the marriage.

Second, you need to discuss your children. You must come up with a child custody agreement so that you know what the plan is for your children. The court will usually decide on the child support issue; however, if you and your ex can come to an agreement that meets or exceeds the requirements set by the applicable laws, the court might accept your child support agreement.

Third, you might need to discuss spousal support if this is going to be a component of the divorce. You should also take the time to address any other concerns or questions you have so that you have a divorce order that includes them all.

With each category of decisions, you need to make sure that you understand your options. Don’t allow yourself to be railroaded into something you aren’t comfortable with. Protect your interests and your children’s interests.
